These Terms of Service (“Terms”) govern your access to and use of the Medical Tours India website and facilitation services. By using our website, submitting an inquiry, or engaging our services, you agree to these Terms. If you do not agree, please do not use our services.
1. About our services
Medical Tours India is a medical tourism facilitator. We help patients explore treatment options in India, connect with independent hospitals and specialists, and arrange logistics such as consultations, travel support, accommodation, airport transfers, and interpreters.
We are not a hospital, clinic, diagnostic center, pharmacy, or licensed healthcare provider. We do not practice medicine, diagnose conditions, prescribe treatments, or perform procedures. Clinical decisions are made solely by licensed medical professionals and the patient.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to submit an inquiry or enter into an arrangement with us. If you inquire on behalf of another person, you confirm you are authorized to share their information and act on their behalf for coordination purposes.
3. No medical advice; informational content only
Content on this website—including treatment descriptions, cost ranges, timelines, success-rate style statements, hospital listings, doctor profiles, and testimonials—is for general information and educational purposes only. It is not medical advice and must not be used as a substitute for consultation with a qualified physician.
Always seek the advice of a licensed medical professional regarding any medical condition or treatment decision. Never disregard professional medical advice because of something you read on this site or in our advertising.
4. Inquiries, consultations, and coordination
When you request a free consultation or submit a form, you authorize us to review the information you provide and share relevant details with partner hospitals or specialists for evaluation, second opinions, or appointment scheduling.
Opinions, quotes, treatment plans, and timelines from partner providers are their responsibility. We do not guarantee that a particular doctor or hospital will accept your case, that a treatment will be recommended, or that an opinion will match your expectations.
5. Pricing, savings claims, and payments
Any cost estimates, “up to X% savings,” or comparisons to prices in other countries are approximate illustrations based on typical published or quoted ranges and may change. Final costs depend on the hospital, doctor, procedure complexity, length of stay, implants/consumables, currency fluctuations, and your individual medical needs.
Unless expressly agreed in writing, Medical Tours India does not charge for initial inquiry handling. Hospital bills, doctor fees, diagnostics, medications, travel tickets, visas, hotel stays, and similar expenses are paid to the respective providers under their terms. We are not responsible for third-party billing errors or refund policies.
6. Travel, visas, and logistics
Visa eligibility, entry requirements, and travel restrictions are determined by government authorities. We may assist with documentation guidance but do not guarantee visa approval or travel outcomes. You are responsible for valid passports, visas, insurance, and compliance with immigration and health rules of India and your home country.
7. Advertising and promotions
Ads on Google, Meta, and other platforms are promotional. They are subject to these Terms and our Disclaimer and Privacy Policy. Ad claims about cost savings, wait times, outcomes, or hospital affiliations are generalized marketing statements and may not reflect every patient’s experience. Landing pages linked from ads are part of this website and governed by these Terms.
8. User responsibilities
- Provide accurate, complete information and medical documents needed for coordination.
- Do not misuse the website (including scraping, introducing malware, or attempting unauthorized access).
- Do not submit unlawful, defamatory, or infringing content.
- Comply with hospital instructions, preoperative requirements, and local laws while traveling for care.
9. Intellectual property
All website content, branding, logos (including the Medical Tours India logo), and materials are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, or redistribute them without prior written permission, except for personal, non-commercial viewing.
10. Third-party services
Partner hospitals, airlines, hotels, payment processors, and other vendors are independent. Their services are governed by their own terms and policies. We are not liable for their acts, omissions, delays, quality of clinical care, or facility standards beyond our role as a facilitator, except where required by applicable law.
11. Disclaimers of warranty
THE WEBSITE AND OUR FACILITATION SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE ACCESS, OR THAT ANY TREATMENT OUTCOME, TIMELINE, OR COST WILL BE ACHIEVED.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDICAL TOURS INDIA AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE WEBSITE OR OUR SERVICES.
Our total liability for any claim arising out of these Terms or our facilitation services shall not exceed the fees actually paid by you to Medical Tours India for facilitation services in the three (3) months preceding the claim (excluding amounts paid directly to hospitals or other third parties). Nothing in these Terms excludes liability that cannot be limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless Medical Tours India from claims arising out of your misuse of the website, inaccurate information you provide, or your breach of these Terms, except to the extent caused by our gross negligence or willful misconduct.
14. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in New Delhi, India shall have exclusive jurisdiction, subject to any mandatory consumer protections in your place of residence.
15. Changes
We may update these Terms periodically. The “Last updated” date will reflect changes. Continued use after updates means you accept the revised Terms where permitted by law.
